What is being compared?
AI governance involves legislation, subordinate rules, and executive policy. A useful comparison asks who has which obligations, how they are enforced, and when they apply, rather than inferring regulatory intensity from policy objectives alone.
Korea: promotion and enforceable duties
The version consulted is Act No. 21311, partially amended January 20, 2026, effective January 22. That amendment date is not the original enactment date.
It is incorrect to describe the Act as having no sanctions. Article 43 provides administrative fines of up to KRW 30 million for specified failures involving notification, domestic representation, and suspension or corrective orders. This does not mean every breach has the same sanction. Official Article 43
EU: distinguish application dates
The Commission states that the Act entered into force on August 1, 2024, with general application on August 2, 2026. GPAI obligations applied from August 2, 2025. Its current guidance distinguishes December 2, 2027 for specified high-risk areas and August 2, 2028 for high-risk AI embedded in regulated products. Earlier timelines should not be presented as current. European Commission guidance
United States: a policy plan is not a statute
The White House released its AI Action Plan on July 23, 2025, organized around innovation, infrastructure, and international diplomacy and security. It expresses executive policy rather than replacing every legal obligation applicable to a business. The plan alone does not justify calling the United States unregulated. Official White House announcement
An analytical perspective
My view is that these approaches cannot usefully be placed on a single strong-to-weak regulatory scale. Jurisdiction, business role, use case, and timing all matter. The balance between innovation and trust should be assessed through specific obligations and enforcement arrangements.
Correction record
October 19, 2026: Corrected the claim of no Korean sanctions and the date ambiguity; aligned EU dates with current official guidance. Removed unsupported bill counts, voting totals, and claims of reproducible real-time API collection.
